Terms of Service

Welcome to CargoNova. By accessing or using our platform (cargonova.in) and associated mobile applications, you agree to these Terms of Service. Please read them carefully.

1. About CargoNova

CargoNova is a transport management software platform operated by Nexonowa IT Solutions ("we", "us", "our"). We provide tools for transporters in India to manage trucks, drivers, trips, billing, GST invoicing, and related operations.

2. Account Registration

• You must provide accurate and complete information when creating an account.
• You are responsible for keeping your login credentials confidential.
• You must be at least 18 years old and authorized to enter contracts in India.
• One account per company — multiple users can be created within one company account.
• We reserve the right to suspend or terminate accounts that violate these terms.

3. Subscription & Payments

• CargoNova offers tiered annual subscription plans — current pricing is shown on our pricing page.
• All subscription fees are charged annually in advance, plus applicable GST (18%).
• Payments are processed via Razorpay, our payment partner.
• Subscription auto-renews unless cancelled before the renewal date.
• Refunds are handled on a case-by-case basis — see Section 4.

4. Refund Policy

• 7-day refund window: Full refund available within 7 days of first payment if you've used fewer than 5 trips.
• Pro-rata refunds are not offered after the 7-day window.
• Refunds for service issues caused by CargoNova will be evaluated individually.
• To request a refund, email support@cargonova.in with your account details.

5. Acceptable Use

You agree NOT to:

• Use CargoNova for any illegal activity, including transporting prohibited goods.
• Submit false GST numbers, fake invoices, or fraudulent documents.
• Attempt to reverse-engineer, hack, or interfere with the platform.
• Use automated tools (bots, scrapers) without our written permission.
• Share your account with anyone outside your company.
• Misrepresent driver locations or trip data to customers.

6. Data Ownership

• You own all data you enter into CargoNova — customer records, trip data, GST invoices, etc.
• You can export your data at any time via the platform's export features.
• We retain anonymized usage data for product improvement (no personally identifiable info).
• On account termination, you have 90 days to export data before permanent deletion.

7. GPS Tracking & Driver App

The CargoNova Driver mobile app collects GPS location data only when:

• A driver is logged in and has an active trip assigned.
• The driver has granted location permissions on their device.
• The driver has explicitly started GPS tracking for a specific trip.

You are responsible for obtaining driver consent for location tracking under applicable Indian labor and privacy laws.

9. Limitation of Liability

To the maximum extent permitted by law:

• CargoNova is provided "as is" without warranties of any kind.
• We are not liable for indirect, consequential, or punitive damages.
• Our total liability is limited to the subscription fees paid in the 12 months prior to the incident.
• We are not responsible for losses from incorrect data entered by users.

10. Intellectual Property

• CargoNova, the logo, and software are owned by Nexonowa IT Solutions.
• You may not copy, modify, distribute, or create derivative works.
• Your business data (customers, trips, etc.) remains yours.

11. Modifications to Service & Terms

We may update these Terms or modify features at any time. Material changes will be communicated via email or in-app notice at least 15 days in advance. Continued use after changes constitutes acceptance.

12. Termination

• You may cancel anytime from your account settings.
• We may terminate accounts that violate these Terms or remain unpaid for 30+ days.
• On termination, access ends immediately. Data export is available for 90 days.

13. Dispute Resolution

• These Terms are governed by the laws of India.
• Disputes will be resolved through good-faith negotiation first.
• Unresolved disputes are subject to the exclusive jurisdiction of courts in Ghaziabad, Uttar Pradesh.

These Terms are governed by:

• Indian Contract Act, 1872
• Information Technology Act, 2000
• GST Act, 2017 and related rules
• Consumer Protection Act, 2019
